Warwick Davis

Warwick is a competition policy expert specialising in network industries. He applies economic theory and quantitative techniques to analyse competition policy issues, including:

• the scope and form of access regulation,
• efficient regulated service pricing,
• anti-competitive conduct investigations and merger assessment, and
• harm or damages valuation.

He has almost 30 years of experience as a professional economist. This includes over 20 years in consulting and six years working for telecommunications and competition regulators in Australia (ACCC) and the United Kingdom (Ofcom). He has been recognised as a leading competition economist by Lexology Index (formerly Who’s Who Legal) for a number of years.

Regulatory design

Regulatory design in economics commonly addresses the scope and means of service provision under substantial market power. Warwick has advised on more than 100 projects covering the design and implementation of regulatory frameworks in the following sectors:

• Telecoms, with Australian clients including the ACCC, NBN Co, Optus, Vodafone Hutchison, TPG Telecom, Uniti, NSW Telco Authority and Commonwealth Agencies
• Digital industries, including in relation to E-commerce platforms in Singapore for the competition authority, for a digital platform on the substitutability of messaging services and for Amazon on responding to proposals relating to ex ante regulation of digital platforms
• Rail transport, with clients including Cooperative Bulk Handling (WA), Aurizon (South Australia and Queensland), and Queensland Rail
• Aviation, with clients including Qantas and Virgin
• Ports, with clients including Viterra (SA), Essential Services Commission of Victoria, AAT terminals
• Taxis, with clients including Uber, the Victorian Government and the Essential Services Commission of Victoria

Merger and competition assessment

Warwick regularly advises corporations, legal teams and financial parties on the anti-competitive consequences of mergers, particularly in telecommunications and transport sectors. Examples of projects include:

• Advising on network and spectrum sharing arrangements, mergers between mobile operators, and acquisitions of mobile and fixed fibre assets.
• Mergers in softwood, retail fuel, supermarkets, airlines, passenger transport, waste, grain handling and retail liquor.

He has also advised parties on allegations of anti-competitive conduct, with clients in sectors such as aviation, supermarkets, postal services and healthcare, and the valuation of damages in sectors such as motor vehicles, cement and airports.
